Terms of Use (the “Terms”) form a legally binding contract between you and Duon Technologies Incorporated (“Duon”, “we”, “us”, or “our”). It outlines the rights and obligations for your use of the Duon Wayfinding App (the “App”). If you  install or continue to use the App, you agree to these Terms. If you do not agree, please do not use the App and remove it from your devices.

1. Description
This App provides users with a wayfinding service that utilizes internet data to assist in locating and navigating users to their intended destinations. The service is provided “as is” and “as available.” We do not guarantee that the service will be uninterrupted, timely, secure, or error-free.

2. License
You are granted a non-exclusive, non-transferable, non-sublicensable, and revocable license to use this App solely for  private, personal, and non-commercial purposes, based on these Terms.

3. Eligibility
You must be at least 18 years old to use this App. By using the App, you represent and warrant that you meet this age requirement.

4. User Accounts
To access certain features of the App, you may be required to create an account. You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account. You acknowledge that your account shall only be accessible by you and that you shall not transfer or assign your account to anyone other than yourself. You agree to notify us immediately of any unauthorized use of your account.

5. General Conduct
You agree to use the App only for lawful purposes. You are prohibited from:
• Doing acts that damage, disable, overburden, impair, reverse engineer, decompile, distribute, publicly display, disrupt, or otherwise interfere with the use of the App.
• Attempting to gain unauthorized access to any part of the App, its related systems, or networks.
• Uploading, posting, or otherwise transmitting any material that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, libelous, or otherwise objectionable.

6. Advertisements
From time to time, commercial information or sponsored advertisements (“Ads”) from third parties may appear on the App. We do not endorse, recommend, or guaranty the reliability of these Ads. YOU GUARANTEE THAT YOUR CONTINUED USE OF THE APP OR ANY ATTEMPT TO CLICK ON ADS WILL BE DONE IN A SECURE MANNER. YOU ARE RESPONSIBLE FOR YOUR OWN SAFETY.

7. Intellectual Property
All content on the App, including but not limited to text, graphics, logos, images, and software, is the property of Duon, its suppliers, or affiliates, and is protected by applicable intellectual property laws.

8. Privacy
In compliance with data privacy regulations, your use of the App is governed by our Privacy Policy.

9. Disclaimer
The App is provided on an “as is” and “as available” basis. We make no representations or warranties of any kind, express or implied, as to the operation of the App or the information, content, materials, or products included on the App.

10. Limitations
To the fullest extent permitted by law, Duon shall not be liable for any damages of any kind arising from the use of the App, including but not limited to direct, indirect, incidental, punitive, and consequential damage. ALWAYS USE THE APP RESPONSIBLY. YOU ASSUME SOLE RESPONSIBILITY FOR YOUR USE OF THE APP.

11. Indemnification
You agree to indemnify, hold free and harmless, and defend at your own expense Duon, its officers, directors, employees, agents, licensors, and suppliers from and against all claims, losses, expenses, damages, and costs, including reasonable attorneys’ fees, arising from or relating to your use of the App or any violation of these Terms.

12. Changes/Modifications
We reserve the right to modify these Terms at any time. Any changes will be effective immediately upon posting on the App. Your continued use of the App after any such changes constitutes your acceptance of the new Terms.

13. Cancellation
You can cancel or terminate your use of the App at any time. Please use the “Delete Account” function in the App Settings. Duon reserves the right to temporarily or permanently terminate your use and access to the App for any violation of these Terms without prior notice.

14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Republic of the Philippines.
